OBTAINS VICTORY IN FEDERAL COURT CASE

Sami AlKarim is a 43 year old Iraqi refugee. He is a well known artist, husband, and father of four U.S. born children. He has resided in Denver for over eight years awating citizenship. On April 30, 2002, Mr.Alkarim submitted Form I-485 application to the United States Citizenship and Immigration Services(USCIS) to obtain adjustment of residency status from refugee to legal permanent resident (LPR)

When Mr.Alkarim resided in Iraq, he was associated with the Islamic Dawa Party(IDP) which was in opposition to the reigning Saddam Hussein government. The United States Government currently supports the IDP prime minister Nouri-al Maliki, but Mr.Alkarim’s association with this party labels him as a member of a Tier III terrosrist group. USICS has refused to make a decision on Mr.Alkarim’s I-485 application, because of this affiliation, for eight years.

On March 29, 2010, Judge Robert. E. Blackburn of the United States District Court, granted Mr.AlKarim’s Motion for a Summary Judgement . This decision compels USCIS to adjudicate Mr.AlKarim’s I-485 application. Jeff Joseph, Esq., who represented Mr.AlKarim in this matter stated the following, “The battle is far from over and I anticipate that USCIS will deny the I-485 and we will have to file a new lawsuit challenging the unlawful denial, but at least the client gets what he has been waiting for 8 years to receive: A decision.”
